We have for review New Sea Escape Cruises, Ltd. v. Florida Department of Revenue, 823 So. 2d 161 (Fla. 4th DCA 2002), which expressly and directly conflicts with the decision in Dream Boat, Inc. v. Department of Revenue, 28 Fla. L. Weekly D837 (Fla. 1st DCA Mar. 27, 2003), notice invoking discretionary review filed, No. SC03-637 (Fla. Apr. 9, 2003). We have jurisdiction. See art. V, Â§ 3(b)(3), Fla. Const. For the reasons stated herein, we approve the decision below and disapprove the district courts decision in Dream Boat.
